The rampant price control effort to support artificially high prices in the high-end audio industry is a tired act. Representing all consumers, the Audio Robin Hoods at MSS HiFi will be bringing Sherman Act anti-trust violation lawsuits in United States Federal Courts against the most notorious violators in the high-end audio industry, one at a time. This is how manufacturers in this business fix prices:
1) They divide this country into territories, one exclusive dealer for each territory. That dealer is allowed to sell within his designated area only. This territory division is a severely anti-competitive behaviour.
2) They forbid all dealers from advertising at a price lower than the MSRP. This is known as vertical price fixing.
3) They act as an agent wielding the big baton against particular dealers that other dealers complain about. This behaviour facilitates the cooperation of multiple dealers with the endorsement of the manufacturer to single out and boycott the dealer or dealers that they perceive as detrimental to their overall price fixing strategy. This is an example of horizontal price fixing, which is per se illegal under the Sherman Act.
Anyone who is familiar with this business has to have wondered about how the things that manufacturers and their dealers do to control selling prices could possibly be legal. Well, it is not. It's just that no one has bothered to challenge the status quo yet.
If you are a consumer, all you have to do is to continue to support MSS HiFi. We will bring seachange to this business. Go back and take a look at the price and features of a state of the art laptop computer in 1995, and compare it to the price and features of a state of the art laptop computer today (2011). You will notice that today's best laptop computers sell for less than in 1995, and they are so much better. To a lesser extreme, look up the retail price and features of a standard Mercedes S-class automobile, and compare it to the retail price and features of a standard Mercedes S-class in 2011. You will see much better features and performance with only about 30% higher prices. Now lets look up a state of the art 200W high-end stereo amplifier in 1995, maybe $8000 retail. Then compare it to a state of the art 200W high-end stereo amplifier today - easily $25,000 MSRP and at best 25% better sounding. Anti-competitive behaviour means out of control pricing and no real innovations.
If you are a dealer, and wrongfully terminated by a manufacturer, either acting on their own or in collaboration with their price-fixing partners/dealers, you must follow our example, take up arms and go on the attack.
